View Full Version : State (FL) limits on Red Grouper?

Basically a guy I know broke the rules and got caught with 2 red grouper, he later hired a lawyer and got the whole thing dropped because FS has the regs posted incorrectly. He knew what he was doing and I think he needed to be fined, but I digress.
How seriously do you think those boys are about fisheries regulations and fighting for good science if they don't even police their website. Or am I off base here?

I think the guy is a dirtbag for knowingly breaking the law, the FWC should post the correct bag limits though.
The guy may have got off by hiring a lawyer, but he still got stuck paying the lawyer's bill.
What is unfortunate about the FWC posting the wrong rules is, someone may pick up one of the brochures, and think they are following the law, only to get cited for exceeding the bag limit and then having to hire a lawyer to defend them.
The guy you know got what he deserved by getting stuck with a bill from an attorney.
PatMyGreen 09-04-2007, 10:17 PM Its not the FWC its those wanne be scubaboarders at Florida Sportsman... but I completely agree with you about the dirt bag. If it makes you feel any better he spent the next day in the chamber on a table 6, karma can be a bitch that way.

On the website, it says it came 'From the Florida Fish & Wildlife Commision, January 2007'
Is that what is in the FWC regulations?
Another rule I bet many people are not aware of is the use of circle hooks are now mandatory for all saltwater fishing when using live or dead natural bait, I do not disagree with the rule, but it is one that can bite an unsuspecting person in the ass.

These are the old January 2007 regs from the FWC, they say 1 red grouper. Thats another thing, it is now septemeber and the regs were updated in July so the regs on the FS forum are not only wrong but outdated as well... top notch work there.

I think he should have been convicted, I was under the impression that the FWC was posting the wrong bag limits.

Ed Walker 09-05-2007, 12:00 AM I bet the lawyer cost him far more than the fine for an extra red grouper.
Dive4Blood 09-05-2007, 08:24 AM I think the guy is a dirtbag.
Shooting one red grouper over the current legal limit.......a limit that was created based on science that was subsequently proven to be completely erroneous makes one a dirtbag? The reality of the situation is that he should be legally able to harvest as many red grouper and he can gags....five. Based on consistent anecdotal observation of many divers in the GOM over time the red grouper limit probably should be even higher than five. This man is not a poacher, he is a freedom fighter! Viva la revolucion!
Hey Bret, I'm glad your ancestors weren't involved in the Revolutionary War. I'm pretty sure that's the case otherwise we would still be wearing powdered wigs, drinking tea at 3PM, and have f*cked up teeth .

My point about him being a dirtbag is using a lame excuse of erronious information on a website as a defense, when he knew what the bag limits are.
I am sure his legal fee's exceeded the fine for the Red grouper that was over the limit, but I guess his case can be used as a defense in the future to oters who want to exceed the bag limit.
I disagree with getting the bag limit on Red Grouper cut from 5 to 2, then 2 to 1, but I follow the law.
BTW if the guy wants to get 5 gags, he better hurry up before we get screwed again.
