It used to be illegal without a warrant. Now, all you have to do is make a phone call to a relative overseas, and big brother can listen in. The democrats caved in- they are such cowards.
McConnell viscerally objected to a Democratic proposal to limit warrantless surveillance of foreigners' communications with Americans to instances in which one party was a terrorism suspect. McConnell wanted no such limits. "All foreign intelligence" targets in touch with Americans on any topic of interest should be fair game for U.S. spying, he said, according to two participants in the Aug. 2 conversation.
So yeah, no terrorism suspect, no suspicioun of terrorism, all you have to do is make a phone call (btw, Canada is a foreign country) to give free reign for fishing by Bush and his cronies.
...the new law will enable the high-tech collection of foreign communications without judicial scrutiny on a vastly larger scale than previously possible, allowing billions of phone calls and e-mails inside as well as outside the United States to be routinely screened for possible links to terrorism and other security threats.

My belief is the post and other news organizations are *pissed*. Think about it, they want to report on a news story overseas, and make a phone call, and someone will be able to listen in. No oversight. No warrant. Do you really believe that it'll only be used for 'terrorism'? NFW. If *I* were an agent and overheard someone talking about not even a crime, but maybe something suspicious, I'd send someone knocking or put them under surveillance. (ref: thoughtcrime). Or maybe a less honest agent could get some info and blackmail you?
I work in telecommunications, and know far too well how easy 'lawful intercept' (that's the name of this category of service is)- and without warrants, could have banks of machines listening for anything suspicious and putting your name on a 'list'.
I will be contacting my senator and hope others will do the same.
